PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING THE FORGED APPLICATION. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING FORGED, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. PARTIES AND ACCEPTANCE

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and KUMOSOFT INC, a Delaware corporation with its registered address at 651 N Broad St STE 201, Middletown, DE 19709, United States ("Company," "we," "us," or "our"). By creating an account, accessing, or using FORGED (the "App"), you represent and warrant that you have the legal capacity and authority to enter into these Terms.

2. ELIGIBILITY AND AGE REQUIREMENTS

2.1 Minimum Age

You must be at least 13 years of age to create an account and use FORGED. If you are between the ages of 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf, and that your parent or legal guardian consents to your use of the App.

2.2 Parental Consent and COPPA Compliance

FORGED does not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent as required by the Children's Online Privacy Protection Act ("COPPA"). If we learn that we have collected personal information from a child under the age of 13 without verifiable parental consent, we will take commercially reasonable steps to delete such information promptly. Parents or guardians who believe their child under 13 has provided personal information to us may contact us at hiclipmatic@gmail.com to request deletion.

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Account Creation

To use certain features of the App, you must create an account using Google Sign-In or Apple Sign-In. You agree to provide accurate, current, and complete information during the registration process.

3.2 Account Responsibility

You are solely responsible for maintaining the confidentiality and security of your account credentials, including but not limited to your authentication tokens, passwords, and any device on which you are logged in. You agree to notify us immediately of any unauthorized use of your account. You accept full responsibility for all activities that occur under your account, whether or not authorized by you.

4. DESCRIPTION OF SERVICE

FORGED is a gamified task management and social competition application. The App allows users to create and manage tasks, earn experience points ("XP") for task completion, progress through clan levels, compete with friends on leaderboards, and access premium features through paid subscriptions.

5. SUBSCRIPTIONS AND PAYMENTS

5.1 Premium Subscriptions

The App offers optional premium subscription plans at various price points (monthly, weekly, and yearly). Subscription pricing is subject to change and may vary based on promotional offers, timing, and other factors.

5.2 Auto-Renewal

All subscriptions automatically renew at the end of each billing period at the then-current rate unless canceled at least 24 hours before the end of the current billing period.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds or credits will be provided for partial billing periods.

6. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree not to engage in any of the following prohibited activities:

• Use the App for any unlawful, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to any portion of the App
• Upload, post, or transmit any offensive, obscene, defamatory, or harassing content
• Interfere with or disrupt the App's infrastructure
• Use bots, scrapers, or automated means to access the App
• Manipulate XP totals, leaderboard rankings, or any gamification elements
• Impersonate any person or entity
• Attempt to reverse-engineer or decompile the App
• Create multiple accounts to circumvent bans or manipulate features

7. USER-GENERATED CONTENT

You may upload profile pictures and create content through the App. You retain ownership of any original content you create, but by uploading or creating content through the App, you grant KUMOSOFT INC a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute such content.

8. INTELLECTUAL PROPERTY

The App, including all software, source code, designs, graphics, artwork, text, logos, trademarks, and all other intellectual property contained therein, is owned by or exclusively licensed to KUMOSOFT INC and is protected by United States and international copyright, trademark, patent, and trade secret laws.

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KUMOSOFT INC EXPRESSLY DISCLAIMS ALL WARRANTIES.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KUMOSOFT INC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

KUMOSOFT INC ("Company," "we," "us," or "our") operates the FORGED mobile application (the "App"). This Privacy Policy describes how we collect, use, disclose, retain, and safeguard your information when you use the App. By creating an account and using the App, you consent to the data practices described in this Privacy Policy.

1. INFORMATION WE COLLECT

1.1 Information You Provide Directly

• Email Address: Obtained through your Google Sign-In or Apple Sign-In authentication. Used solely for account authentication and management.
• Display Name and Username: A display name and unique username chosen by you during account setup.
• Profile Picture: An image optionally uploaded by you. Displayed on your profile, on leaderboards, and in friend lists.
• Character Gender Selection: A selection made by you during onboarding that determines the visual appearance of your in-app character.
• Age: A numerical value provided by you during onboarding. Used solely for eligibility verification and age-gating purposes.
• Task Data: Information about tasks you create within the App, including task names, categories, completion status, time limits, reminders, recurrence settings, and associated metadata.
• Friend Connections: Records of friendships you establish and manage within the App.

1.2 Information Collected Automatically

• User ID (UUID): A universally unique identifier automatically assigned to your account upon creation.
• Device Identifiers: A device identifier collected for the purposes of analytics, crash reporting, and performance monitoring.
• Usage Data: Information about your interactions with the App, including features accessed, tasks created and completed, XP earned, leaderboard views, session duration, app navigation patterns, screen views, and feature engagement metrics.
• Crash Data and Diagnostics: Technical information automatically collected when errors or crashes occur.

2. HOW WE USE YOUR INFORMATION

• Account Creation and Authentication: To create, verify, maintain, and secure your account.
• Core App Functionality: To enable and deliver the App's features, including task management, XP calculation and tracking, clan level progression, streak counting, leaderboard ranking, and friend connections.
• Profile Display: To display your profile picture, display name, username, XP total, clan level, and streak count on your profile, on leaderboards, and in friend lists visible to other users.
• Customer Support: To respond to your inquiries, troubleshoot issues, and provide customer support when you contact us.
• Analytics and App Improvement: To understand how the App is used, to monitor and analyze usage trends and patterns, to improve App performance, stability, and user experience, and to develop new features.
• Security and Fraud Prevention: To detect, investigate, prevent, and address fraud, abuse, unauthorized access, and other illegal or harmful activities.

3. HOW WE SHARE YOUR INFORMATION

3.1 Information Visible to Other Users

As part of the App's social and competitive features, certain information about you is visible to other users who are your friends within the App or who view leaderboards. This includes: your display name, username, profile picture, total XP, clan level, and streak count.

3.2 Third-Party Service Providers

We share information with the following categories of third-party service providers solely as necessary to operate and provide the App:

• Supabase (Cloud Infrastructure): Supabase provides our backend database, authentication services, and cloud storage.
• Google (Authentication): When you sign in with Google, Google processes your authentication credentials.
• Apple (Authentication and Payments): When you sign in with Apple, Apple processes your authentication credentials and in-app purchase transactions.
• Superwall (Subscription Management): Superwall manages paywall presentation and subscription-related events.

4. DATA STORAGE AND SECURITY

4.1 Storage Location

Your data is stored on cloud servers operated by Supabase, our third-party infrastructure provider. Profile images are stored in Supabase Storage. Our data is primarily processed and stored in the United States.

4.2 Security Measures

We implement commercially reasonable administrative, technical, and physical security measures designed to protect your information, including:

• Encryption in Transit: All data transmitted between the App and our servers is encrypted using HTTPS/TLS protocols.
• Secure Local Storage: Authentication tokens are stored securely on your device using iOS Keychain.
• Database Security: Row-level security (RLS) policies are implemented on database tables to restrict data access to authorized users.
• Authentication Security: OAuth 2.0 protocols are used for authentication through Google and Apple Sign-In.

5. DATA RETENTION

5.1 Active Accounts

We retain your personal data for as long as your account remains active and as needed to provide you with the App's services.

5.2 Deleted Accounts

When you delete your account through the App's settings or request account deletion by contacting us, all of your personal data is permanently deleted from our active systems. Account deletion is permanent and irreversible.

6. YOUR RIGHTS AND CHOICES

6.1 Access Your Data

You may access your profile information, task data, XP, and other account data at any time through the App. You may request a complete copy of the personal data we hold about you by contacting us at hiclipmatic@gmail.com.

6.2 Delete Your Data

You may permanently delete your account and all associated data at any time using the account deletion feature in the App's settings.
